2.40.010 Appointment--Composition--Procedures--Absences.

Unless otherwise provided by the Home Rule Charter, all boards and commissions shall be appointed by the council and shall have such powers and perform such duties as are provided by the Charter or by ordinance. Members of such boards and commissions shall be appointed to serve without compensation, but shall be paid their authorized expenses actually incurred in the discharge of their official duties. Initial appointments by the council shall specify the term of office of each individual in order to achieve overlapping tenure, and thereafter, all appointments shall be for the full term specified. No member of any board or commission shall serve more than three consecutive terms of office. Any member serving on a board or commission at the time this limitation on the length of service becomes effective may complete his or her current term of office. If a past board or commission member who has served the maximum amount of tenure permitted by the ordinance codified in this section desires to recommence service on that board or commission, the past member may be reappointed only after an absence of at least two years from the board or commission. All members shall be subject to removal by a three-fourths majority vote of the entire council. The council shall make appointments to fill vacancies for the unexpired terms. In the event a person is appointed to fill a vacancy on a board or commission for an unexpired term and the time remaining to serve under the unexpired term is less than one-half of the entire term of office, the period of time the new member serves to fill out the unexpired term shall not constitute a term of the new member and the new member shall be eligible to serve three consecutive full terms thereafter. In the event the time remaining to serve under the unexpired term is equal to or greater than one-half of the entire term of office, the period of time the new member serves to fill out the unexpired term shall constitute a term of the new member and the new member shall be eligible to serve two consecutive full terms thereafter. Each board and commission shall choose its own chairman and vice-chairman, and shall adopt its own rules of procedure for the conduct of its business. If any member of any board or commission shall be absent for three successive regular meetings and shall fail to attend the fourth meeting, the council shall consider whether such member should be removed from the board or commission. The roll call shown on the minutes of the board or commission shall be conclusive evidence of a member's presence or absence at a particular meeting.
