3.16.093 Certificate of discharge of lien.

A. If any real or personal property is subject to a lien for payment of tax due to the city under this chapter, the finance director may issue a certificate of discharge of any part of the property subject to the lien if the finance director finds that the fair market value of that part of such property remaining subject to the lien is at least twice the amount of the unsatisfied tax liability plus the value of any liens on the property that have priority over the city's lien.
B. If any real or personal property is subject to a lien for payment of tax due to the city under this chapter, the finance director may issue a certificate of discharge of any part of the property subject to the lien if the finance director is paid in partial satisfaction of the tax liability an amount determined by the finance director to be not less than the value of the city's interest in the part of the property so discharged. In determining the value of the part of the property to be discharged, the finance director shall consider the fair market value of the property and the value of any liens on the property that have priority over the city's lien.
C. A certificate of release of lien issued under this section is conclusive evidence that the city's lien upon the property is extinguished, but does not extinguish or release any portion of the lien on property not specified in the release. (Ord. 1993-7 Exh. B (part))
