A. Except as otherwise provided in subsection B of this section, it is unlawful for any person to possess an open container containing an alcoholic beverage within the passenger compartment of a motor vehicle or while seated on a motorcycle, while such vehicle is parked or traveling on a public street or public parking lot, or while such vehicle is in motion.

B. This section shall not apply to any person transporting not more than one opened and resealed container of partially consumed vinous liquor in accordance with C.R.S. § 12-47-411(3.5). (Ord. 2004-26 § 1)
