10.08.010              Definitions.

For purposes of this Chapter, the following terms shall have the following meanings:

1.             "Local delivery" means a delivery of goods or services from any truck that leaves a through truck route in order to reach a destination for the delivery within the City.

2.             "Through truck traffic" means any truck traveling through the Village that does not have an origination or destination within the City.

3.             "Truck" means a motor vehicle in excess of ten thousand (10,000) pounds gross vehicle weight which is designed to transport property and is used for commercial purposes. (Ord.2005-36, prior code 8-26-1through 8-26-5)

10.08.020              Truck routes established.

A.            The following truck routes are established for through truck traffic within the City:

1.             Interstate 25.

2.             Interstate 225.

3.             South University Boulevard from East Belleview Avenue to Columbine Way (part of Colorado State Highway 177).

4.             East Belleview Avenue from the western City boundary to I-25.

5.             East Arapahoe Road from I-25 to South Emporia Street.

B.            The following truck routes are established within the City for local deliveries:

1.             South Quebec Street from East Belleview Avenue to East Caley Avenue.

2.             East Orchard Road from South Yosemite Street to South Quebec Street.

3.             DTC Boulevard from East Belleview Avenue to East Orchard Road.

4.             East Belleview Avenue from the I-25 to DTC Boulevard.

5.             South Yosemite Street from East Orchard Road to East Arapahoe Road.

6.             East Arapahoe Road from Syracuse Way to I-25.

7.             South Clinton Street from East Arapahoe Road to the southern City boundary. (Ord.2005-36, prior code 8-26-1through 8-26-5)

10.08.030              Signs.

A.            The City shall cause all truck routes except highways which are part of the National System of Interstate and Defense Highways and state highways to be posted with signs identifying them as truck routes.

B.            Signs designating a truck route shall comply with the Manual on Uniform Traffic Control Devices.  Signs for truck routes for local deliveries shall include wording such as "NO TRUCKS EXCEPT LOCAL DELIVERIES" or similar wording.

C.            A street, road, or highway is not a truck route, or a part thereof, unless posted as such, or unless the highway is a state highway or a part of the National System of Interstate and Defense Highways.  State highways and highways which are part of the National System of Interstate and Defense Highways are truck routes, but need not be posted as such. 10.08.040              Use required.

A.            Every truck operated within the City for deliveries shall proceed over a truck route, shall deviate from that route only at the intersection which is nearest to a destination point, and shall proceed to the destination point by the shortest available route.  Upon leaving a destination point, a truck shall return to a truck route by the shortest available route, unless the shortest available route to the nearest truck route is longer than the shortest available route to the next destination point.  Upon leaving its last destination point, a truck shall return to a truck route by the shortest available route.

B.            Any person convicted of a violation of this Chapter shall be subject to the following fines:

1.             First offense:  one hundred dollars ($100.00).

2.             Second offense within any twelve (12) consecutive months:  two hundred dollars ($200.00).

3.             Third or subsequent offense within any twelve (12) consecutive months:  three hundred dollars ($300). (Ord.2005-36, prior code 8-26-1through 8-26-5)

10.08.050              Permit required.

No person shall operate within the City a vehicle which is in excess of the weight or size limitations contained in Part 5 of the Model Traffic Code unless such person has first obtained a permit from the City for such operation. (Ord.2005-36, prior code 8-26-1through 8-26-5)

10.08.060              Exceptions.

This Chapter shall not prohibit:

A.            The operation of emergency vehicles upon any street in the City;

B.            The operation of trucks owned or operated by the state, a county or a municipality, a public utility, or a contractor engaged in the repair, maintenance, or construction of streets, street improvements, or utilities upon any street in the City; or

C.            The operation of a truck on any street which has been designated by the City as a detour from a designated truck route. (Ord.2005-36, prior code 8-26-1through 8-26-5)

10.08.070              Evidence of points of origin and destination.

Any person operating a truck upon a street, road, highway or portion thereof in the City which is not a through truck route shall have in his or her possession a log book, delivery slip or other evidence of points of origin and destination to justify the presence of the truck upon such street, road, or highway.  (Ord.2005-36, prior code 8-26-1through 8-26-5)
