15.38.085 Rezoning procedure for town center district (except Denver Technological Center town center district).

  1. Procedure and Fee. The procedure and fees for rezoning applications shall be the same as set forth in Chapter 15.52 of this title.
  2. Adoption of Master Development Plan. Rezoning to the town center district shall be subject to a master development plan, which shall be adopted concurrent with the approval of a rezoning application to the town center district. The master development plan shall specify allowed land uses, allowed building floor areas for each type of land use and by each major land area, parking ratios to be applied, landscaping and open space requirements, minimum setbacks, maximum building heights, design standards for signage and lighting, if known, the existing and proposed street system for providing access to each major land area, and other such regulations on development of the property. The master development plan shall provide a statistical table showing the amount of existing and allowed development, and existing and required parking, landscaping and open space for each of the major land area. The master development plan may require the approval of site plans for individual properties prior to development, and shall specify the content required and approval process for such site plans.
  3. The City Council may, in its discretion, approve a rezoning application even though the corresponding master development plan deviates from the requirements of Sections 15.38.040 through 15.38.080, if the plan specifies what development standards will be implemented in lieu of those established by Sections 15.38.040 through 15.38.080 and the City Council is satisfied with the substitute standards.
