15.76.010 Purpose and intent.

A. The purpose of this chapter is to:
1. Provide an administrative method to foster development plans for eligible lands which serve public objectives more fully than development plans permitted under conventional zoning regulations.
2. Establish criteria for identifying those parcels of land and/or sites in the city which are eligible for the special procedures available to applicants proposing creative development plans requiring special review and approval procedures.
B. The intent of this chapter is to ensure that:
1. Residential development in the form of cluster homes, patio homes or townhomes is permitted.
2. Approval of residential cluster development is granted only if the subject parcel is large enough to make innovative and creative site planning possible, and is located on the edge of a developable area and serves as a buffer between residential and non-single family residential zones.
3. Applicants for residential cluster development have the professional capability to produce a creative plan.
4. The public interest in achieving goals stated in the comprehensive plan will be better served by the residential cluster development than the application of conventional zoning and subdivision regulations.
5. The advantages to landowners afforded by the residential cluster development will be balanced by public benefits.
6. Natural or man-made features and resources, such as topography, trees, watercourses, and the like are preserved. (Ord. 1999-12 § 1 (part))
