15.76.130 Modification.

Applications for modification to an approved residential cluster development shall be submitted to the city planner and shall include all plans, maps, studies and reports that may reasonably be required to make determinations called for in the modification request.
A. Time of Modification.
1. Before Occupancy. Minor modifications proposed for a project prior to or during construction, but before occupancy, shall be processed administratively. Such requests shall be submitted for review prior to commencement of any changes.
2. After Occupancy. Modifications of a project after occupancy shall be classified as major or minor modifications, depending on the nature of the work and request, and shall be processed in the following manner:
B. Types of Modification.
1. A major modification to any residential use within a planned development consists of exterior structural alterations to more than one dwelling unit or to change the purpose of the common areas. Such modifications shall be referred to the planning and zoning commission and a public hearing shall be held in accordance with the procedures established in Chapter 15.52.
2. A minor modification to any residential use within a residential cluster development project is any exterior structural alteration to one dwelling unit. Such modifications shall be determined by the city planner.
C. Findings. Before recommending approval or approving a modification to a residential cluster development, the city planner or planning and zoning commission shall find that:
1. The proposed modification is consistent with the original purpose and reasons for approval and the original conditions of approval;
2. The proposed modification meets the regulations for the zone district, or conforms to previously approved planned variations; and
3. The proposed modification maintains the usable open space as originally approved for the site. (Ord. 1999-12 § 1 (part))
