A. Except as otherwise expressly provided in this Chapter, any accessory structure with a footprint greater than fifty (50) square feet shall comply with the applicable accessory structure setbacks for the zone district in which the property is located, regardless of whether a building permit is required for such structure. No accessory structure with a footprint greater than fifty (50) square feet shall be located in a front yard.
B. Except as otherwise expressly provided in this Chapter, any accessory structure in a rear yard or side yard with a footprint less than or equal to fifty (50) square feet shall be set back at least five feet (5') from the property line, regardless of whether a building permit is required for such structure. An accessory structure in a front yard with a footprint less than or equal to fifty (50) square feet shall comply with the applicable front yard accessory structure setback in the zone district in which the property is located.
C. On any property subject to a subdivision plat or planned unit development that establishes specific accessory structure setbacks, those setbacks shall control. If a subdivision plat or planned unit development establishes setbacks without designating those setbacks as accessory structure setbacks or principal structure setbacks, the established setbacks shall not control accessory structures, and this Chapter shall control accessory structures on such property. Accessory structures may occupy not more than thirty percent (30%) of the rear yard or thirty percent (30%) of the side yard. (Ord. 2008-24 § 2)
A. An accessory structure permit shall be required for the construction or placement upon a lot of any accessory structure with a footprint greater than fifty (50) square feet but less than one hundred twenty (120) square feet. An applicant for an accessory structure permit shall submit a completed application to the Community Development Director. Such application shall include a statement concerning the proposed use of the accessory structure, a plot plan showing the proposed location of the accessory structure in relation to the property lines and other structures on the lot, and a sketch or written description of the height, dimensions and type of the accessory structure. Issuance of an accessory structure permit shall not constitute approval of the structural integrity of the accessory structure.
B. A building permit shall be required for the construction, erection or placement upon a lot of any accessory structure with a footprint of one hundred twenty (120) square feet or greater. The application for such a permit shall be processed in the same manner as other building permit applications.
C. If an accessory structure is constructed, erected or placed upon a lot without the permit required by this Section, the City may conduct a special investigation prior to the issuance of such a permit. An investigation fee in an amount to cover the City's costs shall be assessed in addition to the applicable permit fee, whether or not a permit is subsequently issued. (Ord. 2008-24 § 2)A. Permanent outside toilets, water closets and privies are prohibited accessory structures.
B. Accessory structures are prohibited on any residential property on which no principal building has been constructed.
C. No accessory building shall be used as a dwelling unit, other than for temporary guests or persons employed on the property on which the accessory building is located. (Ord. 2008-24 § 2)Detached garages shall comply with the applicable principal building setbacks for the zone district in which the property is located. (Ord. 2008-24 § 2)
A. A deck twelve inches (12") or less in height shall be setback a minimum of five feet (5') from the property line.
B. A deck greater than twelve feet (12') in height shall not be considered an accessory structure, and shall therefore comply with the principal building setbacks for the zone district in which the property is located.
C. A deck greater than twelve inches (12") in height, but less than twelve feet (12') in height shall be subject to the accessory structure setbacks for the zone district in which the property is located. (Ord. 2008-24 § 2)A. A patio in the front yard shall comply with the front yard accessory structure setback for the zone district in which the property is located.
B. A patio in the side yard or rear yard shall be set back a minimum of five feet (5') from the property line. (Ord. 2008-24 § 2)
An outdoor kitchen shall comply with the applicable accessory structure setbacks in the zone district in which the property is located. (Ord. 2008-24 § 2)
15.82.090 Swimming pool equipment.
Pumps, filters and other equipment associated with a swimming pool shall comply with the applicable accessory structure setbacks for the zone district in which the property is located. (Ord. 2008-24 § 2)
Hot tubs shall comply with the applicable accessory setbacks for the zone district in which the property is located. (Ord. 2008-24 § 2)
Play structures shall be located in a side yard or rear yard, and shall be set back a minimum of five feet (5') from the property line. (Ord. 2008-24 § 2)
15.82.120 Skateboard structures.
A skateboard structure shall not exceed forty inches (40") in height, and the footprint of a skateboard structure shall not exceed fifty (50) square feet. (Ord. 2008-24 § 2)
